1.1 These terms and conditions shall apply to your use of this site and your contract with the Company for any purchases made from the Company.

Pricing

2.1 All prices listed on this website are in New Zealand dollars and include GST.

2.2 All prices are correct at the time of publication however, the Company reserves the right to alter prices for any reason. If this should happen after you have ordered goods the Company will contact you prior to processing your order.

3.1 Terms of Payment & Delivery

3.1.1 If you are a New Zealand customer you may purchase goods using cheque, direct credit, cash, lay-by MasterCard or Visa; or by arranging finance with Fico Finance Limited. If you are an International customer you may purchase goods using Direct Credit, Telegraphic Transaction or Bank Draft. GST does not have to be paid on exported goods. Shipment costs are applicable and these will be included on the special order invoice. The destination country may charge import duties, taxes and fees on items that are being imported. Duties, taxes and fees vary by country. These charges are not included in our special order invoice price, as they are charged directly to you. We recommend that you research import charges before placing an order.

3.1.2 Goods will be sent to you by CourierPost as soon as possible after the Company obtains confirmation from its bank that your credit card payment has been received or from Fico Finance that finance has been approved and payment will be made to the Company for goods ordered. All goods will be accompanied by an appraisal and a diamond certificate.

3.2 Secure Credit Card Payment

3.2.1 In order to ensure that your credit card payment is as secure and safe as possible, the Company is using Westpac Bank's gateway for payment. This means that your credit card details are captured, processed and stored using 128bit encryption and not disclosed to the Company.

3.2.2 In addition, the Company uses "Verified by Visa" and "MasterCard Secure Code". These help to maintain even tighter security with an additional password when using Visa or MasterCard online. If you are a Verified by Visa or MasterCard Secure Code participant you will be prompted for your password when you purchase from this site. 3.3 Risk

3.3.1 The risk in the goods supplied by the Company shall pass to you when you sign for the goods on the delivery of the courier parcel.

3.4 Damaged Goods

3.4.1 If any goods are damaged in transit you must return them to the Company (to the address set out below) within 3 working days of receiving them. The Company will replace any goods damaged in transit and refund the cost of you returning then to the Company as soon as it is reasonably possible for it to do so.

3.5 Returns Policy

3.5.1 If the goods received by you are not the same as the goods you have ordered you may return these goods to the Company (at the address set out below) within 30 days of receipt by you.

3.5.2 Provided that the goods sent to you are received by the Company in their original condition (including the original copies of the diamond certificate and appraisal) and do not differ from the goods sent to you (as evidenced by both the Company's records and those of the valuer who prepared the diamond certificate and appraisal), the Company will replace these goods with the goods ordered. The cost of returning goods to the Company will be at the Company's cost.

3.5.3 Any goods which show signs of wear or which have been re-sized (by a jeweller other than the Company), engraved, altered or damaged cannot be returned.

3.6.2 The Company takes no responsibility for returned goods until they are received and signed for by the Company on delivery.

4.1 The copyright, trademarks and other intellectual property rights in the Company's name and the goods displayed on this website are and remain the property of the Company.

7.4 The site's content, information and advice is free of charge unless otherwise stipulated. You are responsible for your own network and connection charges.

7.5 Other than connecting to this site using a web browser, you may not attempt to access the Company's servers by any means.

7.6 You agree not to disrupt, modify or interfere with this site or its associated software, hardware or servers in any way and you agree not to impede or interfere with others use of this site. You further agree not to alter or tamper with any information or materials on or associated with the Company or this site.

7.7 You will be liable and indemnify the Company (and its officers, employees, agents and contractors) against any loss, damage, expense or cost that they may incur as a result of your use of this site or from any breach by you of these terms and conditions.

Privacy

8.1 The Company works to ensure that your credit card details and personal information are kept safe. Your credit card details are not received or held by the Company, which receives payment via the payment system described above.

8.2 The Company will only collect customer information that is necessary for its business. For example, when you order online, the Company needs your name, email address, mailing address, credit card number and expiration date. This enables the Company to process your order and to notify you regarding its status.

8.3 The Company will ensure that your personal details are accurate, complete and up-to-date at the time these details are used or collected.

8.4 At your request the Company will let you know what sort of personal information is held, how it has been collected and how it is used and give you the right to correct any information which is incorrect.

8.5 The Company only collects personal information by lawful means. From time to time, the Company may also wish to collect non-personal information from customers to help it in its ongoing efforts to improve this website and on-line service.
